1. Definitions and identity of the supplier
In these terms "supplier" means the entity behind PulseGuard as stated on the Contact page. "Consumer" means any natural person who does not act in the course of business.
2. Applicability
These terms apply to every offer made by PulseGuard and to every agreement concluded remotely between the supplier and the consumer. Deviations are only valid if expressly agreed in writing.
3. Offer and product information
We take care to provide clear product descriptions, prices and conditions. Manifest errors or mistakes in the offer do not bind the supplier. PulseGuard is a home blood pressure and heart rate monitoring device. It does not constitute a medical treatment, diagnosis or replacement for professional medical advice. Monitoring results should always be interpreted in consultation with a qualified healthcare professional.
4. Formation of the agreement
The agreement is formed once the consumer has completed the order process in full and the supplier has confirmed the order (for example by email). The supplier reserves the right to refuse orders for justified reasons, such as incorrect details or suspected abuse or fraud.
5. Prices, VAT and payment
All consumer prices are in South African Rand (ZAR) and inclusive of VAT at the applicable rate, unless stated otherwise. Any additional charges will be clearly shown before the order is completed. Payment takes place via the payment methods offered on the checkout page.
6. Delivery and fulfilment
Orders are delivered to the address provided by the consumer within South Africa. Stated delivery times are indicative. Exceeding an indicative delivery time does not automatically give rise to a claim for damages, unless mandatory law provides otherwise.
If delivery of an ordered product proves impossible, we will inform the consumer as soon as possible and offer, where possible, a suitable solution (for example a refund or alternative).
7. Right of return (30-day cooling-off period)
Consumers have the right to return the product without giving reasons within 30 days of receiving it, in accordance with the CPA and our commercial guarantee.
- The return period begins on the day after receipt of the product.
- To initiate a return, a clear notification is sufficient (e.g. by email).
- After notification the product must be returned within a reasonable period.
8. Return conditions and refund
Returns must be carefully packaged. We may charge for any reduction in value resulting from handling beyond what is necessary to assess the nature, characteristics and functioning of the product.
After correct processing of the return, a refund will be made via the same payment method used for the original purchase, unless expressly agreed otherwise.
9. Conformity and statutory guarantee
The consumer is entitled to a product that meets the reasonable expectations arising from the agreement and the CPA. Statutory consumer rights remain fully in force.
10. Commercial guarantee
PulseGuard offers a 30-day money-back guarantee under the conditions on this website. This commercial guarantee does not affect mandatory statutory consumer rights under the CPA.
11. Consumer obligations
The consumer provides accurate and complete information when placing an order and in all communications. Any inaccuracies that lead to delays or additional costs may be charged to the consumer to the extent permitted by law.
12. Liability
The supplier is not liable for indirect loss, consequential loss or loss of profit, except in cases of intent or gross negligence and to the extent that limitation of liability is permitted by law. Nothing in these terms limits rights that may not be excluded under mandatory consumer law.
13. Medical disclaimer
PulseGuard is a home monitoring device for blood pressure and heart rate. It does not make a medical diagnosis, does not treat any condition and does not replace professional medical advice, therapy or emergency care. Consumers with persistent elevated readings, symptoms or medical uncertainty should consult a doctor or call emergency services without delay. PulseGuard readings are informational and should not be the sole basis for any medical decision.
14. Intellectual property
All text, images, design, logos and other content on the website are owned by the supplier or rights holders. Use, reproduction or distribution without prior written permission is not permitted, unless lawfully allowed.
15. Privacy and data protection
Personal information is processed in accordance with POPIA and as described in the privacy policy.
16. Complaints procedure
Complaints about the performance of the agreement must be submitted within a reasonable period, fully described, via the contact details on the contact page. We aim to respond substantively within a reasonable timeframe.
17. Applicable law and disputes
These terms and agreements are governed by the laws of the Republic of South Africa. Disputes will be submitted to the competent court in South Africa, without prejudice to mandatory rules on consumer protection and jurisdiction, including access to the National Consumer Commission (NCC) and the Consumer Goods and Services Ombud (CGSO).
18. Changes to terms
We may amend these terms when legislation, business operations or services require it. The version in force at the time of ordering applies to that order, unless mandatory law provides otherwise.
